1. Acceptance of Terms
By accessing or using the InhibiTic™ website (InhibiTic™.com), applications, and services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use our Services.
2. Intellectual Property
2.1 Ownership
All content, designs, text, graphics, logos, icons, images, audio, video, software, algorithms, methods, processes, and other materials on this website and within our Services (collectively, "Content") are the exclusive intellectual property of InhibiTic™ and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
2.2 Restrictions
You may not, under any circumstances:
- Copy, reproduce, distribute, transmit, display, publish, or create derivative works from any Content without prior written permission from InhibiTic™
- Reverse engineer, decompile, disassemble, or attempt to derive the source code, algorithms, methods, or technical specifications of any InhibiTic™ product, service, or technology
- Use any robot, spider, scraper, or automated means to access or extract data from our Services
- Remove, alter, or obscure any copyright, trademark, or proprietary notices
- Use our Content or Services to develop a competing product or service
- Use the InhibiTic™ name, logo, or trademarks without express written permission
2.3 Patent Rights
InhibiTic™'s technology, including but not limited to its closed-loop neuromodulation system, premonitory urge detection methods, on-demand stimulation architecture, EEG-based classification algorithms, and headband design, is the subject of pending patent applications. Any unauthorized manufacture, use, sale, or importation of technology covered by these patent applications is strictly prohibited and will be pursued to the fullest extent of the law.
2.4 Enforcement
InhibiTic™ actively monitors for intellectual property infringement and will pursue all available legal remedies, including but not limited to injunctive relief, monetary damages (including treble damages for willful infringement), and recovery of legal fees. Any violation of our intellectual property rights will result in immediate legal action.
3. User Content and Data
By submitting data through our Services (including tic logs, cognitive scores, clinical reports, and waitlist information), you grant InhibiTic™ a limited, non-exclusive license to store, process, and use such data to provide and improve our Services, subject to our Privacy Policy. You retain all ownership rights to your personal health data.
You represent that any data you submit is accurate to the best of your knowledge and does not violate any third-party rights.
4. Medical Disclaimer
InhibiTic™ is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition. The Services are provided for informational and research purposes only. Nothing on this website or within our applications constitutes medical advice. Always consult a qualified healthcare professional before making any changes to your treatment regimen. Do not discontinue or modify prescribed medication without consulting your physician.
5. Limitation of Liability
To the fullest extent permitted by applicable law, InhibiTic™ and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from your use of or inability to use the Services, whether based on warranty, contract, tort, or any other legal theory.
In jurisdictions that do not allow the exclusion or limitation of liability, our liability is limited to the maximum extent permitted by law.
6. No Warranty
The Services are provided on an "as is" and "as available" basis without any warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or completely secure.
7. Indemnification
You agree to indemnify, defend, and hold harmless InhibiTic™ and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, or your violation of any third-party rights.
8. Termination
We reserve the right to suspend or terminate your access to the Services at any time, with or without cause, with or without notice. Provisions relating to intellectual property, limitation of liability, and indemnification survive termination.
9. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration in Edinburgh, Scotland, in accordance with the rules of the London Court of International Arbitration (LCIA). Each party bears its own costs. You waive any right to participate in a class action or jury trial.
10. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or website notice. Continued use after changes constitutes acceptance.
